Libya in front of the ICJ in 1992 - Full Case

Finally - after years of trouble (!) - I have managed to bring the full text of the case ruling from 1992. Libya brought the question of interpretation of the Montreal Convention in front of the International Court of Justice in 1992.

The court declined to use any prelimenary actions regarding the case. However there where quite som dissenting opinions from some of the judges. The case became important to international law, because it questioned the balance of power between the UN-Security Council and the ICJ, even though the court itself never wanted to incline to exactly this opinion. Never the less, the questions was raised: what is the exact position between the two legal bodies in international law, and is the ICJ permitted to survey the outcomes of the UNSC ? Legal experts still haven't found an answer to that important question....

There are actually 2 cases, one against the UK, and the other against USA. Each case received seperate decisions, but equal verdict.
Please note: The server of the ICJ is new - and quite slow. Be patient...

Libya vs. UK: Libya's APPLICATION INSTITUTING PROCEEDINGS (filed in the Registry of the Court on 3 March 1992)
Libya vs. USA: Libya's APPLICATION INSTITUTING PROCEEDINGS (filed in the Registry of the Court on 3 March 1992)

Orders

Order of 14 April 1992 - Libya's request for the indication of provisional measures

Order of 19 June 1992

Order of 22 September 1995

As soon as I have the time, I shall write some short comments for every order, to explain the verdicts and the opinions of the judges in a better english for everybody to understand, without having to be experts in international law.
